"You knew your Terms and Conditions of service before joining"
Well, I didn't. As a matter of fact, no one knows such things precisely. We know only what we've generally heard, from people who are probably as ignorant as ourselves.
Who ever bothers to read those complicated things? Also, do you really mean to say that we were aware of each of the literally thousands of policies and notifications that would be applicable to us in the future? When you're 22-23, freshly out of college, ambitious, hungry for a job, bubbling with energy, impatient to prove yourself to the world, you don't care to read all that stuff, much of which is not understandable anyway.
We only come to know of such inequitous policies when we suffer their negative impact.
So much from common sense.
So far as the legality of it is concerned, no
- terms and conditions of service
- express agreement
- implied conditions
- unilaterally-enforced contracts
- notifications / policies
- rules or regulations
can violate your fundamental right to equality.
Who or what is sovereign in our beloved motherland?
Supreme Court? No.
Parliament? No.
President? No
Prime Minister? No.
It's the Constitution of India. It is this Constitution that gives me a fundamental right to equality, to be considered and treated on an equal footing with those who are like me, who fall in the same category as me.
My fundamental rights are sacrosanct and inalienable. My Fundamental Right to Equality is so deeply vested in me that I cannot give it up even if I wish to!
